Being Your Own Lawyer

Appearing in court in pro per means you are representing yourself instead of hiring an attorney. You are not required to hire an attorney. However, before taking legal action, it is strongly recommended that you consult an attorney who can explain important legal rights and options.

An experienced attorney may be able to assess your situation and recommend an appropriate course of action to assert or protect your interests. Not consulting an attorney may lead to delays or added costs later if errors must be corrected.

  • Child visitation
  • Child support
  • Spousal support
  • Use of the residence
  • Payment of debts
  • Division of assets and debts
  • Tax consequences
  • Division of pension and retirement benefits
  • Attorney's fees
  • Other related issues

If you cannot afford an attorney, or if you choose to represent yourself, please be aware that in San Joaquin County:

  • You are responsible for completing all required forms, filing them with the court, and presenting your case to the judge.
  • You must follow the same court procedures, evidence rules, and standards of practice as attorneys. Please review the Local Rules for the Superior Court of California, County of San Joaquin.

Self-help books may be available at your local library, law library, or bookstore. You can also get help with completing, serving, and filing paperwork through the Pro Per Clinic.
