General instructions

There is no filing fee unless the temporary restraining order is denied. If denied, a filing fee of $435.00 is required unless a fee waiver is granted.

  • Forms may be typed or neatly printed in blue or black ink.
  • Filing must comply with California Rules of Court, beginning with rule 2.100.
  • File in the courthouse where the harassment occurred or where the restrained person lives.
  • If filed by 10:00 a.m., orders are generally available for pickup between 3:30 p.m. and 4:00 p.m. the same business day. Filings after 10:00 a.m. are available the next business day.
  • Drop boxes are available from 8:00 a.m. to 4:00 p.m. at Stockton and Manteca branches.

Service by the Sheriff

The San Joaquin County Sheriff’s Office can serve restraining orders. Hours are Monday–Friday, 8:00 a.m. to 5:00 p.m., at 7000 N. Michael Canlis Boulevard, French Camp, CA 95231. Phone: (209) 468-4475. More information is available at Sheriff’s Civil Division.
