General information for unlawful detainers (evictions)

Please review and follow all requirements in current legislation before submitting documents for filing. This helps prevent delays caused by incomplete or incorrect paperwork. 

Submitting your forms for filing

  • Submit all forms required for your specific situation.
  • Complete all required information on each form.
  • If forms are not typed, they must be legibly handwritten in blue or black ink.
  • All forms must be dated and signed by the plaintiff(s) and/or the attorney of record.
  • Submit the original plus copies for yourself and for each defendant. If you want copies returned by mail, include a self-addressed stamped envelope (SASE) with adequate postage. Without a SASE, copies may be placed in the pick-up cabinet at the Stockton Security Desk or the Manteca Clerk’s Office. Documents not picked up within 30 days may be destroyed.
  • Pay the correct filing fee. Current fees are available at www.sjcourts.org/forms-filing/court-fee-schedule/.

If you cannot afford court fees and costs, you may request a fee waiver by completing form FW-001. See the Fee Waiver Form Packet for more information. 

Interpreter needs

All court proceedings are conducted in English. If you need an interpreter, you may request one by completing Judicial Council form INT-300: selfhelp.courts.ca.gov/jcc-form/INT-300.
