Instructions for elder or dependent adult restraining orders
Please read all instructions carefully before filing.
Note: Court employees are prohibited by law from providing legal advice (Government Code §§ 24004 and 68082).
Submitting your forms for filing
- Complete all required fields. Forms must be dated and signed where required.
- Forms must be typed or neatly printed in blue or black ink.
- Lined paper or colored paper is not acceptable for filing.
- Submit the original document only. The Court will provide a filed-stamped copy after the elder abuse restraining order (EARO) is entered by the Court.
- If submitting the originals by mail, include a self-addressed stamped envelope (SASE) with adequate postage to have your copy returned by mail. If you do not include a SASE, copies may be retained at the courthouse until you pick them up. Documents not picked up within 30 days may be destroyed.
- Filing timeframes: Requests filed before 10:00 a.m. are generally ready for pickup at 3:30 p.m. the same day. Requests filed after 10:00 a.m. are generally ready for pickup at 3:30 p.m. the next business day. The clerk will let you know if this changes.
Service of documents

Effective January 1, 2024: The Sheriff’s Office requires the mandatory Judicial Council form SER-001 (Request for Sheriff to Serve Court Papers) and, when applicable, SER-001(A) (Special Instructions for Writs and Levies—Attachment), along with the documents to be served. Forms are available at www.courts.ca.gov/forms.
Interpreter needs
Court proceedings are conducted in English. If you need an interpreter, you may request one by completing and filing Judicial Council form INT-300 (Request for Interpreter) .
Publication
If service by publication is required, the newspaper charges a separate fee. Contact the newspaper directly regarding cost. View the list of approved newspapers (PDF) .
