General instructions for first-time child custody
Please read all instructions carefully before filing for first-time child custody.
Note: Court employees are prohibited by law from giving legal advice (Government Code §§ 24004 and 68082).
Submitting your forms for filing
- Not all forms may be required for every situation. Submit all forms required for your specific case.
- All information must be completed, and all forms must be dated and signed.
- Documents must be typed or neatly handwritten using blue or black ink only.
- Lined or colored paper is not accepted for filing.
- Submit the original documents plus one copy for your records. Failure to provide copies may result in additional fees.
- If you want copies returned by mail, include a self-addressed stamped envelope (SASE) with adequate postage. Documents not picked up within 30 days may be destroyed.
- Provide the correct filing fee. If you cannot afford the fee, you may request a fee waiver using form FW-001. See the Fee Waiver Form Packet .
Interpreter needs
All court proceedings are conducted in English. If you need an interpreter, you may request one by completing and filing Judicial Council form INT-300 (Request for Interpreter) .
Publication
If service by publication is required, additional newspaper fees apply. You must contact the newspaper directly. Download the list of approved newspapers .
